What this Site is

The Site provides information about Division 8 Command, an estimating software product that has not yet been released (the "App"), and lets you join a waitlist for early access.

The waitlist

• Joining the waitlist is free and creates no obligation for you to purchase anything.
• Joining the waitlist does not guarantee access to the App, a place in the first release group, or any particular launch date, price, or feature set.
• We intend to open the first release to 50 operators from the waitlist, and we reserve the right to adjust the size, timing, and composition of release groups.
• We will use your email only as described in our Privacy Policy.

Eligibility

The Site is intended for business users in the United States who are at least 18 years old.

Pre-release descriptions

The App is under active development. Descriptions of features, workflows, and capabilities on this Site describe the product as designed and may change before or after release. Screenshots and product illustrations on the Site are illustrative.

Intellectual property

The Site and its content — including text, graphics, logos, and the Division 8 Command name and mark — are owned by us. No license or rights are granted by viewing the Site or joining the waitlist.

Acceptable use

You agree not to misuse the Site — including attempting to disrupt it, submitting false information, scraping it, or using it for anything unlawful.

Feedback

If you send us ideas, suggestions, or feedback about the Site or the App, we may use them without restriction or obligation to you.

Disclaimers

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site. Our total liability for any claim relating to the Site is limited to one hundred U.S. dollars (US$100).

Governing law

These terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. Any dispute relating to the Site will be resolved in the state or federal courts located in Clark County, Nevada.

Accessibility

If any part of the Site is difficult for you to access, navigate, or understand, or if you need information from us in another format, email support@div8command.com and we will work with you to provide a reasonable accommodation.

General

If any part of these terms is found unenforceable, the rest remains in effect. These terms are the entire agreement between you and us about the Site. Our not enforcing a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a sale or reorganization of the business.

Changes

We may update these terms from time to time. The current version will always be posted here with its effective date. Continued use of the Site after changes means you accept the updated terms.
